Terms & Conditions
Welcome to Aissista! By accessing or using our website, apps, or services, you agree to the following Terms & Conditions. Please read them carefully.
Overview and acceptance
These Terms and Conditions (“Terms”) govern access to and use of Aissista’s websites, applications, browser extensions, APIs, and related services (collectively, the “Service”) provided by Aissista, a Maryland-based company (“Aissista,” “we,” or “us”). By creating an account, installing the Chrome extension, or using any part of the Service, the individual or entity (“Customer,” “User,” or “participant”) agrees to these Terms and to the Privacy Policy.
Changes to terms
We may update these Terms from time to time, and material changes will be communicated via the Service interface, email, or other reasonable means, with the “Last Updated” date revised accordingly. Continued use of the Service after an update becomes effective constitutes acceptance of the updated Terms, and if changes are not acceptable, access must cease immediately.
Eligibility and accounts
The Service is intended for individuals aged 13 or older, and where local law requires a higher age for online consent, that higher age applies, with parent or legal guardian oversight required for users between 13 and 18 as permitted by law. Account information must be accurate and kept confidential, and the account holder is responsible for all activity under the account and for promptly reporting any suspected unauthorized use or security incident.
Services and features
Aissista provides AI-powered productivity tools including instant grammar and spelling checks, tone detection and adjustment, instant rewrites, prompt generation, multilingual translation, prebuilt templates, and a centralized dashboard with features varying by plan and platform. Features labeled alpha/beta/preview are provided “as is,” may change or be discontinued, and may carry additional risks or limitations.
Acceptable use
Users must not violate any applicable law or third‑party rights, upload unlawful or infringing content, attempt to bypass security, spam, scrape, or misuse rate limits or quotas. The Service must not be used to create malware, deceptive deepfakes, unlawful surveillance, or to harvest personal data without appropriate authorization and required notices.
User content, outputs, and licenses
“User Content” includes prompts, files, data, and other materials submitted to the Service, as well as outputs generated for the User, and Users retain ownership of their User Content as between the parties. To operate and improve the Service, Users grant Aissista a worldwide, non‑exclusive, royalty‑free license to host, process, transmit, display, and create derivative works of User Content and outputs solely for service delivery, security, abuse prevention, and legal compliance, subject to product controls and applicable law.
AI outputs and high‑risk use
AI outputs may be inaccurate, incomplete, or inappropriate and are provided for informational purposes only, and Users should evaluate outputs and verify facts before relying on them, especially in professional or regulated contexts. The Service is not designed for high‑risk uses such as medical diagnosis, legal advice, or safety‑critical systems, and such use is prohibited.
Chrome extension permissions disclosures
To meet Chrome Web Store expectations and U.S. privacy norms, the Aissista extension uses narrowly scoped permissions with user‑initiated triggers and clear justifications as follows:
-
activeTab justification: Purpose is to enable on‑page writing assistance only when a user explicitly activates Aissista on the current tab, with access limited to that active tab and no background scraping or persistent monitoring.
-
storage justification: Purpose is to store extension preferences, session state, onboarding completion, and lightweight usage settings using browser storage for a consistent experience; we do not store full document content by default and provide user‑initiated deletion controls.
-
identity justification: Purpose is to support secure sign‑in to associate extension use with an Aissista account and enable plan features and rate limits, using only the basic profile identifiers necessary for authentication.
-
host permissions justification: Purpose is to inject content scripts on specified domains where users edit text (e.g., common web editors) to provide inline suggestions and UI elements, minimizing match patterns and processing content only to provide requested assistance.
Third‑party services
The Service may integrate with third‑party services such as identity providers, analytics, payment processors, and cloud platforms, each governed by its own terms and privacy practices. Aissista does not control or endorse third‑party services and is not responsible for their content, security, or behavior.
Plans, billing, taxes, and refunds
Paid plans, usage‑based fees, and overages are billed according to the then‑current plan details, and fees are generally non‑refundable except where required by law or expressly stated in the plan. Subscriptions renew automatically each term unless canceled before renewal, and applicable taxes and government charges may be collected in addition to plan fees.
Trials and promotions
Trials and promotional credits are time‑limited, non‑transferable, and may not be stacked or obtained fraudulently through duplicate accounts or identities. At trial end, continued use may require selecting a paid plan, and non‑conversion may result in feature limitations or access changes consistent with the free tier.
Referral program terms (points → free limit)
Aissista may offer a referral program that awards non‑cash points redeemable only for in‑product “Free Limit” (e.g., additional requests, characters, or tasks) to eligible participants subject to these rules. Points have no monetary value, do not represent property, cannot be redeemed for cash, are non‑transferable and non‑assignable, and may not be sold, bartered, or exchanged.
-
Earning points: Referrers earn points when new Users sign up via the referrer’s unique link and satisfy eligibility criteria shown in the dashboard, which may include verified email, region eligibility, anti‑abuse checks, or completing onboarding or an extension install.
-
Redeeming points: Points can be redeemed for Free Limit as displayed in the account dashboard, with available redemptions, conversion rates, caps, and expirations subject to change, and Free Limit applying prospectively without crediting past invoices.
-
Anti‑abuse: Self‑referrals, duplicate or fake accounts, misleading promotions, spam, trademark bidding on Aissista marks, coupon/discount site postings, and fraudulent or deceptive practices are prohibited, and violations may result in reversal of points, suspension, or termination.
-
Tracking and disputes: Tracking uses cookies and referral parameters that may be affected by blockers or cross‑device flows, and disputes must be raised within 30 days for review, with Aissista’s good‑faith determination final.
-
Program changes: Aissista may modify, suspend, or terminate the program, accrual, or redemption options at any time, and unredeemed points may expire upon termination as permitted by law.
Intellectual property and feedback
Aissista and its licensors own all rights, title, and interest in the Service, including software, models, interfaces, designs, and trademarks, and no rights are granted except as expressly stated in these Terms. Suggestions, ideas, or feedback may be used without restriction or obligation, and no confidentiality is assumed for unsolicited submissions.
Infringement claims (DMCA)
We respect intellectual property rights and will respond to proper notices alleging infringement, including under the DMCA, and may remove or disable access to allegedly infringing material and suspend repeat infringers as appropriate. Notices should include sufficient detail to identify the material and the claimant’s authority and should be sent to the designated address indicated in our IP policy or legal contact.
Privacy and data protection summary
Use of the Service is subject to Aissista’s Privacy Policy, which explains data collection, use, retention, sharing, and user choices, including details specific to the browser extension and permissions. Users should avoid submitting sensitive personal data unless necessary and permitted and should configure privacy settings to match their preferences and obligations.
Security
We implement reasonable technical and organizational measures designed to protect the Service and data, recognizing that no method of transmission or storage is completely secure. Users should safeguard credentials, enable multi‑factor authentication where available, and avoid sharing sensitive content unnecessarily.
Warranties and disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non‑infringement, uninterrupted availability, or error‑free operation, and no advice or information creates any warranty not expressly stated. We do not guarantee that outputs will meet requirements or be free from errors, and Users assume all risk for their use of the Service.
Limitation of liability
To the maximum extent permitted by law, Aissista and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or substitute goods or services, even if advised of the possibility of such damages. Except where prohibited by law, Aissista’s aggregate liability for all claims arising out of or relating to the Service is limited to the amounts paid by the User during the six months preceding the event giving rise to liability or one hundred U.S. dollars (USD 100), whichever is greater
Indemnification
Users agree to defend, indemnify, and hold harmless Aissista and its affiliates from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from User Content, misuse of the Service, violations of law, or breach of these Terms, with Aissista reserving the right to assume exclusive defense and control. Users must cooperate with Aissista’s defense of any claim within reason and at their expense.
Export controls and sanctions
Users must comply with applicable U.S. export control and economic sanctions laws and must not use the Service in or for the benefit of prohibited jurisdictions, parties, or end‑uses. Users represent they are not on any U.S. government restricted list and will not permit access by restricted parties.
Government users
The Service is commercial computer software and documentation, and U.S. Government users acquire only the rights specified in these Terms consistent with applicable FAR/DFARS provisions. Government use is subject to the restrictions and obligations set forth herein and under applicable law.
Dispute resolution and arbitration (U.S.)
For U.S. users, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration under applicable consumer arbitration rules, with the Federal Arbitration Act governing the interpretation and enforcement of this provision. Exceptions include eligible small‑claims matters and actions seeking injunctive relief to protect intellectual property, and class actions and representative proceedings are waived to the fullest extent permitted by law, with an optional 30‑day arbitration opt‑out made available as disclosed in the product or notice.
Governing law and venue
These Terms are governed by the laws of the State of Maryland, excluding its conflict of laws rules, reflecting Aissista’s status as a Maryland‑based company. For disputes not subject to arbitration, the exclusive jurisdiction and venue are the state and federal courts located in Baltimore, Maryland, and the parties waive objections to personal jurisdiction and venue in such courts.
Suspension and termination
We may suspend or terminate access, remove content, or take other reasonable actions for violations of these Terms, suspected fraud, security risks, non‑payment, or legal compliance reasons. Upon termination, access ceases and Aissista may delete or anonymize data after a reasonable retention period, subject to legal obligations.
Electronic communications; notices
Users consent to receive service announcements and administrative communications electronically, and legal notices may be provided via the Service interface, email, or mailing address provided by the User. Notices to Aissista must be sent to the legal contact listed below or another address we specify for that purpose.
Assignment; severability; non‑waiver
Users may not assign or transfer these Terms without Aissista’s prior written consent, and any attempted assignment in violation is void, while Aissista may assign these Terms in connection with a merger, acquisition, or sale of assets. If any provision is held invalid or unenforceable, the remaining provisions remain in full force, and failure to enforce any provision is not a waiver of rights.
Force majeure
Neither party is liable for delays or failures to perform due to events beyond reasonable control, including acts of God, labor disputes, government actions, internet or hosting failures, or other force majeure events. Performance is excused for the duration of the event, with reasonable efforts to resume performance promptly.
Entire agreement; order of precedence
These Terms constitute the entire agreement between the parties regarding the Service and supersede all prior or contemporaneous understandings on the same subject. To the extent of any conflict between these Terms and specific service descriptions or policies referenced herein, these Terms control unless expressly stated otherwise.
